Scratch through clear coat in my car, how do I use touch up paint?

I have a scratch on my new car and it is through the clear coat since a polish and other things did not take it off. I am going to go to the dealer tommorow to buy black touch up paint. go to www.paintscratch.com. They've got clear coat and paint that you can apply to the scratch. It will probably still show, but at least the paint and body will be protected.
